STEPS IN ACQUISITION OF LAND IN KASOA

 

A prospective purchaser of land may adopt either of two ways namely: informal approach or formal approach in the acquisition of land.

 

In the informal approach, there is no need for a prior written contract of sale before the transaction is concluded but difficulties may arise when the prospective vendor refuses to carry out the terms of the contract. In that case, the buyer will find it extremely difficult to get the court to compel the seller to convey the land to the buyer.

 

The formal approach is where the buyer first enters into a written contract for the sale of the land with the vendor. This approach has the advantage of tying the hands of the seller to afford the buyer more time to investigate the title of the vendor. Whether you are adopting the formal or the informal approach to the acquisition of land in Kasoa and its environs, the following steps will be of great assistance to you.

 

  1. Physical inspection of the land.

 

You must find time to visit the land you intend to buy together with the vendor.  If you do not have time to visit the land by yourself, you must delegate someone or employ the services of a lawyer or a law firm to advise you on the transaction and investigate the title of the vendor on your behalf. Physical inspection of the land will assist you to identify any existing structures or things such as chippings, sand or trees which do not grow naturally on the land. This will cause you to ask questions as to the ownership of those items as they are tell tale signs that someone else is already in possession of the land you intend to buy.

 

  1. Visit the land you intend to buy without your vendor

 

You must find time to visit the land in the absence of your vendor and speak to adjoining land owners about your intention to acquire the said piece of land and find out what they know about the land and whether or not they will advise you to proceed with the transaction and so on.

 

  1. Request for title documents from the vendor

 

After the physical inspection and the preliminary inquiry on the land, you must request your vendor to furnish you with a site plan or any documents that show that he or she has the right to sell the land in question.

 

  1. Conduct searches at Lands Commission

 

Use the site plan or the documents from the vendor to conduct a search at the Lands Commission, Cape Coast to verify the nature of your vendor’s interest in the land. The search may take one or two weeks to complete.

 

 

  1. Independent verification

 

Engage an independent surveyor to verify the identity of the land on the site plan with what is on the ground. 

 

  1. Register the land.

 

Once you have paid fully for the land and the requisite documents have been prepared and executed in your favour by the vendor, you can proceed to register the land documents at the Deeds Registry in Cape Coast.
